Conservative and Independence Petitions Off to Court

The Board of Elections disallowed petitions filed by Gallo and Provenzano for the Conservative and Independence lines.

My understanding is that this matter will be going to court for a decision.  I will be curious to see what the ruling will be.

Once the judge decides, I will announce the decision.

Lmao, you'll be curious to see??? Can't you be somewhat honest and say hey I support Gallo but as a lawyer I know that he's wasting his time in court. The damn drug addict kid won the battle. I agree that Gallo will win the election. The Democrat line is all he needs. It's embarrassing but Shayne will have last laugh in November.

As a lawyer, I know that anything can happen when you go to court. I also know better than to prejudge a case.

According to the Freeman, the envelope had 2 postmarks on it. If there is sworn testimony that said envelope was dropped off to the post office with a legal postmark by the deadline, the judge may find that sufficient. He or she may not as well.

I will wait until the Judge rules and then report. I have seen too many decisions by the Board of Elections overturned in court. I have had some overturned myself. Always best to wait for the judge to rule and never assume you know what a judge will do.

As for your comment about damn drug addict kid, I am not sure what you mean.

As far as the election itself goes, I will support the candidate who, after a court decision and/or a primary, appears on the Conservative Party line. I am after all the City Chairman of the Conservative Party.

There are Supreme Court decisions in the past that have decided that a metered mail postmark is proof of a valid postmarked date by virtue of the fact that all postal meters are the property of the USPS and must adhere to the strict guidelines of USPS rules and regulations.

That is true. There is case law to support the argument. The case is returnable on Tuesday. We will see what happens.

Loved your response to Steve Noble criticizing Democrats being on Conservative Line.(daily Freeman) That gem about his Uncle Jim running on Conservative line was priceless. Somebody ought to remind Steve that the City of Kingston is not the State of NY governing( legislature) body. We don't deal with abortion , Medicaid benefits, food stamps and the like...We all need to cull the many different parties for ideas in how to improve Kingston. We can all work together. I would have liked to hear his reaction to not getting the CSEA endorsement of a Union that votes mostly democratic. If Steve is such a true Democrat how come no love from the Union? I guess they saw right thru him....an empty suit!
