A Residency Question

Apparently, one of the sitting Aldermen filled out a court document listing a primary residence outside of the city.

If this is so, Mayor Gallo, using the precedent of Sottile vs Burns, may vacate the seat.

Paperwork on this case is available online through the PACER service. Unconfirmed scuttlebutt in town alleges that Brad Will listed his primary residence in ths bankruptcy case as Bearsville, NY. The house in Kingston is apparently owned under his wife's name. Next hearing is Nov. 18th at 1130am in Poughkeepsie.

Mr C please enlighten us as to the matter "Sottile v Burns," can't find it....

Alderman Burns listed an address outside of his ward in a petition to run for County Legislator. Mayor Sottile declared Burns' 1st ward Alderman seat vacant for the balance of the term.

It went to court and the judge ruled in favor of Sottile. Thus, Burns lost his seat.

well, well, well...Certainly very interesting!... hoping Will loses his seat to Champs-Doran. God forbid Will ever becoming a Chairman on Finance and Economic committees for City Hall. His ethics would come into question along with his financial acumen.

I assume you refer to the recount. If Champ-Doran wins, it is moot for next term, but not moot for balance of this term.

go on line to the Daily Freeman and do a long term search under Chris Burns, The facts were fairly different in that Chris was actually living down on Wurts Street when he was the alderman from his Washington Avenue work address. Brad Will is actually living in Kingston and for some legal reason is using the Boiceville address on his Federal pleadings while listing the home where he lives in his wife's name. How about we just let this die and wait and see what happens with the absentees?

When a Republican filed a legal document claiming a residence outside his ward, Mayor Sottile threw him off the Council. If a Democrat does the same, we should ignore it? Absolutely not!!

Burns actually claimed that he lived at both addresses and split his time.

If Will claimed a different residence to get some legal benefit, then he should be booted.

you could also file a motion with the Bankruptcy Court to have his bankruptcy case invalidated because he filed a false instrument based on his address.

I guess voters don't care if the alderman has ethical issues? I really wished this case was brought to light before the election cycle. It might have had a different perception with voters in that it would have not been perceived as a political ploy. When a alderman can continually push the bounds of ethical issues it comes across as he is above it all. Very arrogant of an individual. People like this give citizens who do run for political office a bad rap. On the other hand, Brad Will might be just an ignoramus.

Does anybody have a hard copy of this Chapter 13 petition, so we can all see it in black & white? The Federal PACER system is very clunky and I can't get it to work. If anyone has the document in hand, that would save us a round trip to Poughkeepsie.

Brad Will has refused comment on the issue of bankruptcy, also the issue of ethics. But he is willing to comment on the election. Interesting point that he sits on the Kingston Finance & Audit Committee but cannot remain personally solvent in his own finances.

Another thing which perplexes me, is how come everyone with info on Brad Will's bankruptcy filing is so secretive, beating around the bush, not providing the information? Where did this story originate, who initially found out about it, and how? I find it hard to believe that anyone from Kingston simply sits around and trolls through Federal cases over in Bankruptcy Court across the river. It seems like this came from somebody close to Brad Will, like one of his numerous attorneys.

Is Brad attempting to dodge personal liability in the ongoing Pike Plan debacle? The timing is very suspicious.

6:23 You raise an excellent question about dodging personal liability if the Pike Plan becomes an issue. Rumor has it there is also another suit out there against him unconnected to the Pike Plan . Something in his professional life...... That could also explain the bankruptcy proceedings. No money...no awards...
Hard to believe this man was re-elected. So typical of voters ..not doing their homework and believing his Facebook page minions.
His personal and professional life is going to be a distraction to him in his next term. Hoping his residents don't get the short end of the stick.
